Job Description

The Legal Aid Society, the nation's oldest and largest social justice legal services organization, has immediate openings for dedicated, passionate Staff Attorneys in the Criminal Defense Practice Trial offices throughout the city with felony trial experience. The Criminal Defense Practice is the primary public defender in New York City, providing holistic, client-centered vertical representation to over 200,000 people facing misdemeanor, felony, and homicide charges.

A Felony Criminal Defense Attorney will provide zealous advocacy in all phases of a person's criminal legal matter from arraignments through hearings and trials, as well as other related proceedings. Attorneys in these positions must have some experience representing clients charged with felony charges.

The ideal candidate is an NYS admitted criminal defense... attorney who demonstrates a commitment to serving marginalized persons and communities, has extensive criminal court experience, and who vigilantly elevates the value of client centered advocacy using a race, gender equity and social and economic justice lens. Attorneys will be team members that are committed to shaping the defense and client litigation strategy in partnership with other defense professionals and will contribute to a collaborative culture.

ESSENTIAL DUTIES/RESPONSIBILITIES
• Provide client-centered, comprehensive representation from arraignments through trial, disposition or dismissal
• Provide representation at arraignments including interviewing clients; connecting with family and others to aid in bail advocacy; connecting with supervised release, social workers and others to assist in addressing client needs and advocacy; presenting bail arguments and follow up with appropriate referrals
• Prepare cases for advocacy and litigation, including submitting referrals for investigation, referrals for social work services and/or community-based programming as needed, and gathering information and researching law for effective representation
• Conduct bail review hearings and writs of habeas corpus to secure client’s liberty post arraignments
• Coordinate with specialty units to assist in advocacy including DNA Unit, Digital Forensics, Decarceration, Immigration and others
• Consult and coordinate with supervising attorneys for case reviews
• Review discovery materials to challenge certificates of discovery compliance, contest statements of readiness, secure all disclosures under discovery law, and prepare for litigation
• Conduct any preliminary hearings, Crawford hearings, suppression hearings, and other pretrial hearings, and conduct trials
• Prepare mitigation materials to advocate for diversion courts in connection with community-based programs or to advocate for sentencing
• Advise and enter appropriate pleas in consultation and consent of clients addressing any collateral consequences of such plea.
• File appropriate notices of appeal and coordinate with appellate counsel
• Other duties as assigned

Requirements

Candidates MUST have:
• A minimum of 3 years of demonstrated commitment to public defense, racial equity, and social justice with some experience handling felony matters here in NYS or in other jurisdictions.
• Track record of strategically guiding casework, projects and/or relationships, applying good judgement and routinely pushing through roadblocks to achieve your goals
• Clear and effective oral and written advocacy and experience and a high level of organization to meet multiple competing deadlines
• New York State bar admission (or ability to waive into New York State from another jurisdiction)

SALARY TRANSPARENCY

The posting reflects the range of potential salaries for the role. The specific salary offers will be dependent on candidate qualifications, including collectively bargained salary steps for unionized roles.

$79,591 - $130,308

This position offers an attorney with a passion for representing the accused the opportunity to delve into all aspects of criminal defense on the trial and appellate level and expand into civil litigation. Vladeck seeks an experienced criminal defense attorney to join a team that considers client service its utmost value and adheres to the philosophy that effective legal representation must embrace a holistic approach to meeting the needs of the individual client. This associate position will also be afforded the opportunity to learn and assist in plaintiff’s side employment and disability cases.
This position is not a traditional 9 – 5 job and Vladeck is not a traditional law firm. Core Responsibilities
• Management of criminal cases from inception to trial and beyond.
• Draft and prepare reports, briefs, motions, and correspondence.
• Review, analyze, and digest discovery materials.
• Regular court appearances, while managing out-of-court case responsibilities.
• Maintenance of regular, effective, and compassionate communication with clients, including jail visits.
• Participation in potential new client consultations and involvement in client cultivation.
• Litigation of applications, motions, hearings, and trials.
• Develop skills in civil litigation, particularly employment and disability rights law.

Required Qualifications, Skills, and Experience
• Minimum of three years’ experience in a criminal defense practice either in federal court or in a U.S. state or local jurisdiction. Please do not apply with less than three years’ experience.
• Excellent written and verbal communication skills.
• Strong interpersonal skills and the ability to communicate effectively with people from different backgrounds and lived experiences.
• Demonstrated commitment to challenging government overreach and unfairness in the criminal process.

• The ability to handle the pressure and responsibilities of a criminal defense practice.
• Commitment to continuously seek professional and personal development through participation in CLEs and trial skills courses.

The Criminal Defense Practice

The Criminal Defense Practice (CDP) at The Bronx Defenders consists of over 150 attorneys, investigators, social workers, practice associates, and administrators who provide comprehensive criminal defense representation to people in the Bronx facing police and criminal legal system involvement. Through a client-centered approach, our CDP legal teams strive to gain a deeper understanding of the circumstances and priorities of the people we represent. Armed with that understanding, they fight for desired outcomes by strategically raising personalized, persuasive arguments in mitigation, negotiations, and litigation.
Responsibilities
• Engage in intensive client interviewing, counseling, research, writing, oral advocacy and negotiations as part of legal representation
• Zealously advocate for individuals charged with misdemeanor and felony offenses in Bronx Criminal Court from the time of arraignment through disposition or trial, as well as concurrent proceedings such as Department of Motor Vehicle refusal hearings
• Provide comprehensive, team-based representation collaborating with an interdisciplinary team of attorneys and advocates to avoid or mitigate any further legal system involvement or civil consequences that may arise out of contact with the criminal legal system
• Effectively litigate, confidently negotiate and skillfully advocate for the people we represent with judges, prosecutors, and other actors within the systems our clients are navigating
• Co-counsel cases in other venues like Family Court, Civil Court and Administrative Hearings, as necessary and desired
• Participate in holistic advocacy within the practice and in the office
• Participate in internal working groups to develop best practices across referral relationships
• Participate in trainings within the office as well as, on occasion, external community events, conferences and webinars in which BXD is participating or presenting
Qualifications

To be eligible, candidates must have:
• At least 3 years of experience in Criminal Law or a related field

Salary is commensurate with experience. For candidates with 3-10 years of directly relevant experience, the salary range for this position would be approximately $74,392 - $94,350. Approximately 70% of The Bronx Defenders' staff, including attorneys and non-attorneys, are represented by UAW Local 2325 - Association of Legal Aid Attorneys (AFL-CIO). This position is within the bargaining unit.

This position is exempt. By law, nonexempt employees are compensated hourly based on their annual rate and therefore are entitled to over-time, whereas exempt employees are not.
