Job Description

GENERAL DEFINITION:

This is a sophisticated legal position that requires in-depth knowledge of all aspects of divorce in Pennsylvania, and the ability to efficiently perform responsible legal work primarily concerned with divorce matters filed under the Divorce Code of the Commonwealth of Pennsylvania.

Reviewing pleadings, scheduling of pretrial and settlement conferences and review of pretrial and settlement memoranda, relating to all economic issues arising from divorce matters filed under Divorce Code of 1980, as amended. An employee in this class schedules and conducts hearings of all ancillary proceedings and prepares Findings of Fact, Conclusions of Law and makes recommendations to the court for their resolution and prepares property settlement agreements reached in hearings before the Master.

REQUIRED KNOWLEDGE, SKILLS, AND ABILITIES:
• Thorough knowledge of law as it relates to all aspects of divorce, including the divorce statutes, statewide and local rules of civil procedure, and applicable case law.
• Thorough knowledge of the law as it relates to distribution of marital property.
• Thorough knowledge of practices and regulations relating to pension plans as distribution of marital property.
• Extensive knowledge of the rules of evidence.
• Knowledge of laws, statutes, and regulations as they apply to domestic relations issues.
• The ability to assist parties and their respective counsel in the negotiations of complete property settlement agreements.
• Ability to communicate effectively with members of the judiciary, attorneys and the general public.
• Ability to present ideas effectively both orally and in writing.
• Ability to fairly and objectively rule on a multitude of cases that involve highly emotional issues.

REQUIREMENTS:

• Minimum of ten (10) years of experience as a domestic relations attorney, with extensive practice in divorce matters; experience in complex divorce matter strongly preferred.
• Must submit application, resume, writing sample, and a list of the captions and docket numbers of five divorce cases handled that best represent their qualifications to perform the duties of the position. After meeting minimum application standards by a panel review, must complete an evaluation and interview process.
• Successful completion of criminal background investigation.
• City residency required within six (6) months of satisfactory completion of an orientation period.
• Ability to perform essential functions of the position.

ESSENTIAL FUNCTIONS:

ELIGIBLE LIST

DEPARTMENTAL - ONLY PROMOTIONAL : Only a departmental promotional eligible list for the Department of Parks and Recreation will be established as a result of the examination.

Candidates who pass the exam and are placed on the civil service list will be retained on the list for a minimum of one year and a maximum of two years after the establishment of the Eligible List.

PREFERENCE FOR PHILADELPHIA RESIDENTS :
Candidates who have maintained a bona fide residence in Philadelphia for at least one year prior to the date of the civil service examination shall have priority over all other persons receiving an identical test score. For Training and Experience evaluations, in which applicants will not be asked to appear to take a scheduled examination, the residency preference eligibility date is the planned eligible list date listed on this application, May 15, 2023.

To receive such preference, candidates must respond to the question regarding residence later in this form.

The response on this application will be used to determine eligibility for preference for residents. Documentation of residence may be required if there is any question as to whether you meet the residency preference requirements.

ELIGIBLE LIST

DEPARTMENTAL - ONLY PROMOTIONAL - Only a departmental promotional eligible list for the Department of Planning and Development will be established as a result of the examination.

Candidates who pass the exam and are placed on the civil service list will be retained on the list for a minimum of one year and a maximum of two years after the establishment of the Eligible List.

PREFERENCE FOR PHILADELPHIA RESIDENTS :

OPEN - COMPETITIVE - Only an open competitive eligible list will be established as a result of this examination. Permanent City employees will receive no promotional preference in this examination.

RESIDENCY WAIVER - The Civil Service Commission has waived the usual requirement that candidates must be residents of Philadelphia for one year prior to appointment. Instead, establishment of residency in Philadelphia will be required no later than one (1) year after appointment.

Candidates who qualify for this preference and who take and pass open competitive civil service examinations shall have ten points added to their final score. The candidate must successfully pass all parts of the examination before points are awarded.

NATIONAL VOLUNTEER SERVICE PREFERENCE - Up to 5 additional points will be added to the examination score of any candidate who has passed the open competitive examination and who has:

Successfully completed a term of volunteer service with Peace Corps, AmeriCorps NCCC (including FEMA Corps), or AmeriCorps VISTA .
Such candidates will be awarded five (5) points for the completion of a two-year term of service or three (3) points for the completion of a one year term of service.

B. Successfully completed at least 450 hours of service with AmeriCorps State and National (including Teach for America).

Such candidates will have:

• 1 point added to their final score if they have completed 450 Hours of the above service.
• 2 points added to their final score if they have completed 675 Hours of the above service.
• 3 points added to their final score if they have completed 900 Hours of the above service.
• 5 points added to their final score if they have completed 1700 Hours of the above service.

ELIGIBLE LIST

DEPARTMENTAL - ONLY PROMOTIONAL : Only a departmental promotional eligible list for the Department of Aviation will be established as a result of this examination.

Candidates who pass the exam and are placed on the civil service list will be retained on the list for a minimum of one year and a maximum of two years after the establishment of the Eligible List.

PREFERENCE FOR PHILADELPHIA RESIDENTS :
Candidates who have maintained a bona fide residence in Philadelphia for at least one year prior to the date of the civil service examination shall have priority over all other persons receiving an identical test score. If you have maintained a bona fide residence in Philadelphia for at least one year immediately preceding May 8, 2023, you are eligible to claim residency preference.

ANTICIPATED ELIGIBILITY

New employees hired after September 1, 2021, must be vaccinated. U.S. VETERAN'S PREFERENCE :

Ten points for veteran's preference will be added to the scores of eligible veterans who apply for Open-Competitive tests and pass the examination. You must be honorably discharged from the U.S. armed forces. Attach a DD214, member 4, to your application if you wish your eligibility to be reviewed. Spouses of disabled or deceased veterans may also be considered.

LEGACY PREFERENCE :

The children or grandchildren of Philadelphia Firefighters or Police Officers who were killed or died in the line of duty shall be accorded a preference in Open-Competitive civil service entrance examinations. Candidates who qualify for this preference and who take and pass Open-Competitive civil service examinations shall have ten points added to their final score. The candidate must successfully pass all parts of the examination before points are awarded.

NATIONAL VOLUNTEER SERVICE PREFERENCE :

Up to 5 additional points will be added to the examination score of any candidate who has passed the Open-Competitive examination and who has:

A. Successfully completed a term of volunteer service with Peace Corps, AmeriCorps NCCC (including FEMA Corps), or AmeriCorps VISTA

Such candidates will be awarded five (5) points for the completion of a two-year term of service or three (3) points for the completion of a one year term of service.

B. Successfully completed at least 450 hours of service with AmeriCorps State and National (including Teach for America).

Such candidates will have:

· 1 point added to their final score if they have completed 450 Hours of the above service.

· 2 points added to their final score if they have completed 675 Hours of the above service.

· 3 points added to their final score if they have completed 900 Hours of the above service.

· 5 points added to their final score if they have completed 1700 Hours of the above service.

The candidate must successfully pass all parts of the examination before points are awarded.

Employees in this class perform work in one of the following assignments: Biology/Chemistry, Evidence Control or Pattern Evidence. Positions within the Biology/Chemistry assignment prepare samples for analysis by a forensic scientist, enter forensic sample data into databases and perform other basic laboratory and evidence duties. Positions in the Evidence Control assignment receive, analyze, classify and store all evidence submitted to the Office of Forensic Science ( OFS ) or Patrol District or Investigative Unit, coordinate digital evidence activities to include Body Worn Cameras, make recommendations to increase efficiency of evidence submission and storage processes, utilize evidence databases, and assist with forensic forms and reports. OPEN - COMPETITIVE - Only an open competitive eligible list will be established as a result of this examination. Permanent City employees will receive no promotional preference in this examination.

CONCURRENT - Both open competitive and promotional examinations have been announced concurrently.

Departmental and interdepartmental promotional eligible lists of permanent City employees and an open competitive eligible list will be established as a result of these examinations. The appointing authority may make an appointment from either one of the promotional lists until these lists are exhausted and, thereafter, may appoint from the open competitive list.

Permanent City employees will receive no promotional preference in the open competitive examination. Such candidates will be awarded five (5) points for the completion of a two-year term of service or three (3) points for the completion of a one year term of service.

Hiring Bonus – Employees are eligible for a lump sum hiring bonus of $1,500. The bonus will be paid in two parts: $1,000 after the employee has completed three months of satisfactory full-time probationary employment and $500 after the employee has completed twelve months of satisfactory full-time employment. The employees must meet all requirements contained in civil service regulation 6.32 to receive the bonus.

ELIGIBLE LIST

Continuous Eligible List

The examination for this class is announced on a continuous basis. Applications will be accepted indefinitely. The eligible list established as a result will be merged as candidates are tested. Candidates who pass the exam and are placed on the civil service list will be retained on the list for a minimum of one year and a maximum of two years.

Candidates who pass a continuous examination may not apply for the same examination as long as the candidate’s name remains on the eligible list. Candidates who fail or those who pass and whose names are subsequently removed from the eligible list for a continuous examination may apply for the examination again 180 days following the last date on which the candidate took the examination. If a candidate takes an examination sooner, the candidate will be considered examined in error. The candidate’s test papers will not be scored.

Candidates who pass the exam and are placed on the civil service list will be retained on the list for a minimum of one year and a maximum of two years after the establishment of the Eligible List.

RESIDENCY WAIVER : The Civil Service Commission has waived the usual requirement that candidates must be residents of Philadelphia for one year prior to appointment. Establishment of residency in Philadelphia will be required no later than one (1) year after appointment.

Preference For Philadelphia Residents

To receive full credit for your education and experience, you should submit all relevant documentation including college transcripts, licenses, certifications, paid out of class documentation, etc. and provide a detailed description of your education, experience, and credentials.
